By using the Website you agree to these Terms. If you do not agree, please do not use the Website.

1   Relationship to our services agreements
1.1 These Terms govern use of the Website only. They do not create any service relationship and do not govern the supply of any services by EITE.
1.2 Where you engage EITE for technology or marketing services, that engagement is governed by the applicable Master Services Agreement together with the relevant Order Form or Statement of Work (the “Services Agreement”). If there is any inconsistency between these Terms and a Services Agreement in relation to services, the Services Agreement prevails.
1.3 We do not guarantee any particular result from our services. Any examples, case studies, testimonials or figures on the Website are illustrative only. Outcomes depend on factors including budget, your own decisions and priorities, timelines, third parties and market conditions.
1.4 Fees for services are payable for the work and capacity provided under the Services Agreement and are not contingent on achieving any specific result. Refunds, remedies and liability in relation to services are governed by the Services Agreement, subject to the Australian Consumer Law.

2   Use of the Website
2.1 You may use the Website for lawful purposes only. You must not use it in any way that breaches any applicable law, infringes anyone’s rights, or interferes with the Website’s operation or security.
2.2 You must not attempt to gain unauthorised access to the Website, its servers, or any connected system, or introduce malicious code.
2.3 We may suspend, restrict or withdraw all or part of the Website, or your access to it, at any time and without notice, including where we reasonably believe you have breached these Terms.

3   Information & availability
3.1 The information on the Website is provided for general information only and does not constitute professional, technical, legal or financial advice. It should not be relied on as the basis for any decision; seek advice tailored to your circumstances.
3.2 While we endeavour to keep information current and correct, we make no warranties as to its completeness, accuracy, reliability or suitability. Any reliance you place on it is at your own risk.
3.3 The Website is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, timely, secure or error-free, or that defects will be corrected. To the maximum extent permitted by law, and subject to clause 7, we exclude all implied warranties in relation to the Website.

4   Intellectual property
4.1 All content on the Website including text, graphics, logos, images and software is owned by EITE or its content suppliers and is protected by Australian and international copyright and trademark laws.
4.2 You may view, download and print pages for your own personal, non-commercial use. Any other reproduction, distribution or transmission is prohibited without our prior written consent.

5   Third-party links
5.1 The Website may link to third-party sites for convenience. We do not control and are not responsible for the content, accuracy or practices of those sites, and a link does not imply endorsement.

6   Your responsibilities & indemnity
6.1 You are responsible for your use of the Website and for any material you submit through it, and for ensuring you have the right to submit it.
6.2 To the maximum extent permitted by law, you indemnify EITE against any loss, damage, cost or expense EITE reasonably incurs arising from your breach of these Terms or your misuse of the Website. This clause does not apply to the extent the loss was caused by EITE’s own negligence or breach.

7   Limitation of liability
7.1 To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded, EITE is not liable for any loss or damage arising from your use of, or reliance on, the Website or its content.
7.2 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth) that cannot lawfully be excluded.

8   Privacy
8.1 Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

9   General
9.1 Severability: if any provision of these Terms is or becomes invalid or unenforceable, it is severed to the extent necessary, and the remaining provisions continue in full force.
9.2 No waiver: a failure or delay by EITE in exercising any right under these Terms is not a waiver of that right, and no single exercise prevents any further exercise of it.
9.3 Assignment: you may not assign or transfer your rights under these Terms without our consent. We may assign or novate our rights on notice to you.

10 Changes & governing law
10.1 We may update these Terms from time to time by posting the revised version on the Website; the revised Terms take effect on posting.
